O knihe

The general objective of the book is to analyze if Bills 3.842/12, 2.464/2015, 432/13 and 6.442/16, which deal with work in conditions analogous to slavery and rural work, are in accordance with the principle of the prohibition of social regression and, consequently, if they demonstrate a social advance or regression for Brazil. This is because slavery has been a social practice since ancient times, but despite all legislative and political developments to combat it, this violation is perpetuated. In this sense, fundamental rights are central to a Democratic State of Law and, together with constitutional principles, serve as interpretative vectors for all spheres of the legal system, and in this logic of protecting the subject and limiting the State, the principle of the prohibition of social regression arises, which states that the ordinary legislator cannot revoke or restrict benefits linked to social rights protected in the Constitution, unless there is proportional justification and compensatory measures are granted.
