In the Democratic Republic of the Congo, the right of access to justice is a fundamental right provided for in the Constitution of the Democratic Republic of the Congo and international legal instruments. Indeed, Article 19 of the Constitution provides that "everyone has the right to have his case heard within a reasonable time by the competent judge". Article 7 (1) of the African Charter on Human and Peoples' Rights provides that "everyone has the right to have his case heard. This right includes: the right to bring before the competent national courts any act violating the fundamental rights recognised and guaranteed by conventions, laws, regulations and customs in force; the right to be presumed innocent until proven guilty by a competent court; the right to a defence, including the right to be assisted by a lawyer of one's choice...".
