O knihe
This book uncovers three issues in need of immediate attention due to the law governing them being ineffective and not up to the global norms and standards, that have been neglected by the Legislature and the Executive in India. These issues are Death Sentencing or Capital Punishment, Waging War and Manual Scavenging. India's aim behind introducing Capital Punishment has always been to reduce the commission of heinous crimes by virtue of imposing a deterrent effect, seen through the 2013 and 2018 Amendments, which has not been quite successful, due to the rate of commission of heinous crimes continuously increasing. The author, through a legislative and judicial analysis, brings out the need to shift to a more rehabilitative and reformative approach, and make capital punishment more restrictive in nature. When it comes to waging war, the author brings out the ineffectiveness of the existing penal provisions, and the need to revamp them in accordance with the judicial precedents on this line. Lastly, the author shows how Manual Scavenging causes hierarchical discrimination, and the urgent need to address the same through comprehensive suggestions.
