This principle attempts to provide legal certainty where certain scientific knowledge does not yet exist. It undoubtedly constitutes a genuine legal norm whose influence may, however, be more deferred than immediate. The courts will increasingly contribute, in turn, to improving its scope and legal effects. Thus, through the precautionary principle, environmental law takes on a new dimension: it becomes a right of anticipation. This development reflects the concern of international environmental law to protect future generations.
