This book assesses the constitutionality of criminalizing adolescent consensual sex in Kenya. It considers the current legal framework and the legal dram on whether to lower the consent age or not. The judiciary has noted that the courts are filled up with young boys whose only mistake was engaging themselves in sexual relationships with their fellow young girls. This book will therefore consider the options available, Firstly being, whether to lower the sexual age of consent or maintain it at 18? And secondly, whether we should only decriminalize the adolescent sex. In doing so, this paper will look at the international principles that underpin the rights of the children, the children rights and the jurisprudence that is emanating from our courts. Moreover, this paper Will also consider other options available that would take the child offenders away from the formal criminal justice system for instance diversion as has been argued for by various academicians.
