The Ministry of Labor of Ecuador, registers in the Unified Labor System (SUT) extemporaneous termination certificates (Article 635 of the Labor Code establishes the statute of limitations in 3 years), these documents are used to initiate claims for lack of affiliation with the IESS, The Provincial Commission of Benefits and Controversies of the IESS of Imbabura, resolves to declare undue affiliations, because there are contracts with express legal prohibition, such as those between parents and children, who live in the same house and do not have a salary, simulate an employment relationship, violate Articles 8 and 273 of the Labor Code; Labor contracts between spouses are prohibited according to article 218 of the Civil Code, and extemporaneous contracts and termination certificates that exceed the time that proves the existence of the labor relationship, but that are celebrated with current dates, when the right of affiliation is denied, they proceed to sue before a Civil Judge of the Ibarra Canton, in which they obtain a sentence through conciliation.
