The document exposes the evolution of the penitentiary system in Mexico and the progressive progress that has been made since the mid-nineteenth century to the present day regarding jails, prisons, prisons, rehabilitation centers, now called social reintegration centers, which historically have functioned as modules of punishment and punishment to those who transgress the law, also the document incorporates the normative analysis regarding the public policy used that contribute to the prevention, care and punishment of torture in our country.The central thesis of the present work is to expose how and to what extent torture has been a practice of yesteryear indexed to the penalty of deprivation of liberty in the Mexican penitentiary system and to demonstrate the legislative advances and setbacks elaborated and implemented by the presidents who have governed Mexico since 1857 to the present day, in order to demonstrate with hard data that the prison sentence continues with the violations of human rights of the prison population.
