This book deals with two issues which have been discussed in jurisprudence, ethics and political philosophy for severeal years. In the first part, the main question is whether or not the use of torture can be legitimised. There are two cases in discussion: first the threat of torture against a kidnapper to rescue the victim of kidnapping, second the so called 'ticking-bomb-scenario'. The text presents the different opinions within the international discussions and criticises those opinions, which advocate the legitimation of torture in this circumstances. In the second part the book deals with the legal problems the shootdown of a hijacked airplane will have. The case in mind is a situation like the 9/11-act of terrorism. The first chapter of this part discusses the legal consequences the shootdown may have. The final chapter reconsiders the 9/11-case within the context of Carl Schmitt¿s Political Theology'. Besides the presentation and critical discussion of the several opinions the author will develops own solutions to all of the mentioned cases.
